Acceptable Use Policy

Overview

This Acceptable Use Policy ("AUP") outlines the prohibited uses of Sukimail's email marketing platform. This policy is designed to protect our users, maintain high deliverability rates, and ensure compliance with applicable laws and regulations. Violations of this policy may result in immediate account suspension or termination.

1. Prohibited Email List Sources

The following list sources are strictly prohibited:

  • Purchased Lists: You may not use email lists that have been purchased from third parties, regardless of claims about consent or opt-in status.
  • Scraped Lists: You may not use email addresses obtained through web scraping, harvesting, or automated collection methods.
  • Rented Lists: You may not use email lists rented from list brokers or other third parties.
  • Public Directories: You may not compile email lists from public directories, websites, or social media platforms without explicit consent.
  • Third-Party Sharing: You may not use email lists shared by partners, affiliates, or other third parties unless recipients have explicitly consented to receive emails from you.

Required: All email addresses must be obtained through legitimate opt-in methods where recipients have explicitly consented to receive emails from your organization.

2. Prohibited Email Practices

  • Cold Outreach: Sending unsolicited emails to recipients who have not explicitly opted in to receive communications from you.
  • Spam: Sending spam, junk mail, or any form of unsolicited bulk email.
  • Phishing: Attempting to acquire sensitive information through deceptive emails.
  • Fraud: Using the Service for fraudulent activities or to deceive recipients.
  • Malware Distribution: Sending emails containing viruses, malware, trojans, or other harmful code.
  • Misleading Content: Using false or misleading subject lines, sender information, or content.
  • URL Shorteners: Using URL shorteners to obscure the destination of links (unless necessary and properly disclosed).
  • Attachments: Sending attachments without proper disclosure and recipient consent (attachments may be restricted).

3. Required Email Practices

All users must comply with the following requirements:

  • Double Opt-In: We strongly recommend (and may require) double opt-in confirmation for all email subscriptions.
  • Unsubscribe Links: Every email must include a clear, functional unsubscribe link that processes requests immediately.
  • List-Unsubscribe Header: All emails must include proper List-Unsubscribe headers (RFC 2369) and, when supported, one-click unsubscribe functionality.
  • Immediate Processing: Unsubscribe requests must be processed immediately, and recipients must be removed from lists within 10 business days.
  • Suppression Lists: You must maintain suppression lists for bounces and complaints and ensure these addresses are never contacted again.
  • Sender Identification: All emails must clearly identify the sender and include valid contact information.
  • Consistent From Address: Use consistent "From" addresses and sender names that accurately represent your organization.

4. Domain Authentication Requirements

Before sending emails, you must properly configure domain authentication:

  • SPF (Required): Sender Policy Framework records must be properly configured.
  • DKIM (Required): DomainKeys Identified Mail signatures must be set up and verified.
  • DMARC (Recommended): Domain-based Message Authentication, Reporting & Conformance policies are strongly recommended.
  • Domain Verification: You must verify domain ownership before sending is enabled.
  • Dedicated Tracking Domain: Use a dedicated tracking domain aligned with your sender domain for optimal deliverability.

5. List Quality and Compliance

  • List Source Confirmation: You must confirm the source of all imported email lists and provide documentation if requested.
  • Large Import Review: Imports above a certain size may be blocked or limited until reviewed and approved.
  • List Hygiene: You are responsible for maintaining list hygiene and removing invalid, bounced, or unsubscribed addresses.
  • Consent Documentation: You must be able to demonstrate that recipients have consented to receive emails from you.
  • Compliance: All practices must comply with applicable laws including CAN-SPAM Act (US), GDPR (EU), CASL (Canada), and other regional regulations.

6. Sending Limits and Throttling

To protect deliverability and prevent abuse, we implement the following limits:

  • Default Daily Cap: New accounts start with very low daily sending limits.
  • Per-Campaign Limits: Maximum recipients per campaign are enforced.
  • Per-Hour Throttling: Sending rates are throttled to prevent sudden spikes.
  • Warm-Up Plan: Limits increase gradually based on clean metrics and account history.
  • Spike Prevention: Rules prevent sudden increases in sending volume that could harm deliverability.

7. Automated Monitoring and Enforcement

We automatically monitor account activity and enforce compliance through:

  • Bounce Rate Monitoring: Accounts are auto-paused if bounce rates exceed acceptable thresholds (typically 5% hard bounces or 10% total bounces in a rolling window).
  • Complaint Rate Monitoring: Accounts are auto-paused if complaint rates exceed acceptable thresholds (typically 0.1% or 1 complaint per 1,000 emails).
  • Hard Bounce Detection: Sudden spikes in hard bounces trigger automatic pausing and review.
  • Alert System: Email and/or Slack alerts are sent when thresholds are approached or exceeded.
  • Audit Logging: All account approvals, limit changes, and enforcement actions are logged for audit purposes.

8. Account Approval Process

All accounts undergo manual approval before sending is enabled. Our approval checklist includes:

  • Website review to verify legitimate business operations
  • Use case evaluation to ensure appropriate email marketing practices
  • Sender identity verification
  • List source confirmation and documentation
  • Domain ownership verification
  • DKIM and SPF configuration verification

Accounts remain in a "Pending" state until approved, and campaigns cannot be sent until approval is granted.

9. Enforcement Actions

Violations of this Acceptable Use Policy may result in:

  • Warning: First-time minor violations may result in a warning and required remediation.
  • Account Suspension: Serious violations or repeated offenses may result in temporary account suspension.
  • Account Termination: Severe violations, spam complaints, or failure to remediate issues may result in permanent account termination.
  • Legal Action: We reserve the right to pursue legal action for violations that cause harm or violate applicable laws.
  • Reporting: We may report violations to relevant authorities, ISPs, or anti-spam organizations.

11. Changes to This Policy
