1. Acceptance of Terms

By accessing and using Sukimail ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Prohibited Email Practices

The following practices are strictly prohibited:

  • No Purchased or Scraped Email Lists: You may not use purchased, rented, scraped, or harvested email lists. All email addresses in your lists must be obtained through legitimate means with explicit consent from recipients.
  • No Cold Outreach: You may not send unsolicited emails to recipients who have not explicitly opted in to receive communications from you. All recipients must have provided clear, affirmative consent to receive emails from your organization.
  • No Spam: You may not send spam, junk mail, or any form of unsolicited bulk email. This includes emails sent to recipients who have not requested them or who have opted out.
  • No Misleading Content: You may not use misleading subject lines, false sender information, or deceptive content in your emails.
  • No Phishing or Fraud: You may not use the Service to send phishing emails, fraudulent messages, or any content designed to deceive or defraud recipients.
  • No Malicious Content: You may not send emails containing viruses, malware, or any other harmful code or attachments.

3. Required Email Practices

  • Double Opt-In Recommended: We strongly recommend using double opt-in confirmation for all email subscriptions to ensure recipients have explicitly consented to receive your emails.
  • Unsubscribe Links: Every email must include a clear, functional unsubscribe link that allows recipients to opt out immediately.
  • List-Unsubscribe Header: All emails must include proper List-Unsubscribe headers to comply with email standards and improve deliverability.
  • Domain Authentication: You must properly configure SPF, DKIM, and DMARC records for your sending domains. Domain authentication is required before sending.
  • Consistent Sender Identity: You must use consistent "From" addresses and sender names that accurately represent your organization.
  • Immediate Unsubscribe Processing: Unsubscribe requests must be processed immediately, and recipients must be removed from your lists within 10 business days.

4. Account Approval and Limits

All accounts are subject to manual approval before sending is enabled. We reserve the right to:

  • Review your website, use case, sender identity, and list sources before approving your account
  • Set sending limits based on account history, compliance record, and deliverability metrics
  • Require domain ownership verification and DKIM setup before enabling sending
  • Implement default daily, per-campaign, and per-hour sending caps
  • Gradually increase limits through a warm-up plan if metrics remain clean
  • Pause or suspend accounts that violate these terms or show poor deliverability metrics

5. Automated Monitoring and Enforcement

We automatically monitor account activity and may take the following actions:

  • Auto-pause sending if bounce rate exceeds acceptable thresholds
  • Auto-pause sending if complaint rate exceeds acceptable thresholds
  • Auto-pause sending if sudden spikes in hard bounces are detected
  • Send alerts when thresholds are approached or exceeded
  • Maintain audit logs of account approvals and limit changes

6. List Quality Requirements

  • You must confirm the source of all imported email lists
  • Large list imports may be blocked or limited until reviewed
  • You must maintain suppression lists for bounces and complaints
  • You are responsible for ensuring list hygiene and removing invalid addresses

7. Content Restrictions

  • No misleading subject lines or false sender information
  • No URL shorteners in email content (unless necessary and properly disclosed)
  • Attachments are generally not recommended and may be restricted
  • All content must comply with applicable laws and regulations, including CAN-SPAM, GDPR, and CASL

8. Account Suspension and Termination

We reserve the right to suspend or terminate your account immediately if:

  • You violate any provision of these Terms of Service
  • You engage in prohibited email practices
  • Your account shows poor deliverability metrics or high complaint rates
  • You fail to comply with our Acceptable Use Policy
  • We receive complaints or reports of spam or abuse

Suspended or terminated accounts will not be eligible for refunds, except as provided in our Refund Policy.

9. Limitation of Liability

Sukimail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Sukimail, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, violation of these Terms, or violation of any third-party rights.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
